Answers: A good estimate depends upon factors in your marriage and dissolution (divorce) matter which only you and your spouse can answer.  Again, you should first speak to a family lawyer before taking any action. 

Some of these factors include:

    Whether the couple share reasonable expectations about disposition of the marital estate and can decide who keeps which assets and debts;
  • Whether the couple chooses to use the family court proceedings as a new battleground for unresolved conflict and hostile motives;
  • Whether the couple is committed to provide all financial documents required by Florida law or lawfully requested items early or late in the proceedings;
  • Whether the couple shares an agreed upon plan for their children’s future and economic well being;
  • Whether both attorneys have sufficient knowledge of issues and the status of caselaw to know when issues should best be settled or decided by a judge;
  • Whether the couple agree on valuation of assets which is supported by accurate valuations in the market where assets are routinely purchased and traded;
  • Whether complex issues such as future alimony, medical and development needs of a spouse or child require calculation and consideration;
  • Whether intervening facts relating to past or threatened domestic violence, criminal, immigration, international legal interests and taxation matters exist which may undermine the intended effect of a settlement;
  • Whether special valuations and payouts of pension issues and tax considerations make the hiring of an independent professional advisable;
